Topic: Acquittal

Acquittal - Wikipedia, the free encyclopedia
In the common law tradition, an acquittal formally certifies the innocence of the accused, as far as the criminal law is concerned.
The effect of an acquittal on criminal proceedings is the same whether it results from a jury verdict, or whether it results from the operation of some other rule that discharges the accused.
An acquittal, while conclusive as to the criminal law, does not necessarily bar private civil actions in tort or on some other grounds as a result of the facts alleged in the charge.

 FRCRMP - Rule 29 (LII 2004 ed.)
If the court enters a judgment of acquittal after a guilty verdict, the court must also conditionally determine whether any motion for a new trial should be granted if the judgment of acquittal is later vacated or reversed.
If the appellate court later reverses the judgment of acquittal, the trial court must proceed as the appellate court directs.
If the court conditionally grants a motion for a new trial and an appellate court later reverses the judgment of acquittal, the trial court must proceed with the new trial unless the appellate court orders otherwise.

CJLF: Briefs: Price v. Vincent - Argument, Part II B - Conclusion (File 3 of 3)
This is not a grant of power to a reviewing court to superimpose its ideas on that of the trial court.
The Court of Appeals set aside the acquittal, holding that the District Court lacked the power to acquit on this ground.
In Martin Linen, there was an acquittal in both form by the clear grant of a Federal Rule of Criminal Procedure 29(c) motion to acquit and dismiss the jury, see 430 U. S., at 566, and in substance, by the District Court's reasons for granting the motion.

JewishEncyclopedia.com - ACQUITTAL IN TALMUDIC LAW:
An Acquittal once pronounced was irrevocable; the judgment could never be reopened, nor the trial resumed, though the clearest evidences of guilt might thereafter come to light, or though the court had erred most grievously in applying the law.
It may be stated that the rules herein given favoring acquittals did not apply to prosecutions for theft.
Here a difference comes in between the failure to answer under the general cross-questioning on the time and place of a criminal act, which is known as ḥaḳirah (searching), and the free and rambling cross-examination known as bediḳah.

No. 02-524: Price v. Vincent - Amicus (Petition)
Although this Court has held that the grant of an acquittal at the close of the prosecution's case may not be reviewed in an interlocutory appeal, Smalis v.
If a trial court were barred from reconsidering its initial grant of an acquittal, moreover, the attachment of double jeopardy protections would frequently turn on an effort to determine whether the court's extemporaneous remarks from the bench amounted to a concrete ruling in favor of an acquittal.
Instead, the ruling inherently is subject to revision until the entry of final judgment, and a request by the government to reconsider the ruling or a suggestion by the court that the ruling may be reconsidered has the effect of rendering the matter unresolved and the initial ruling non-final.

BCCLA Position Paper: Costs to accused on acquittal, 1983
It would appear then that if technical acquittals are the result of inadequacies in the law, or in the operation of the courts, or the conduct of the prosecution, the remedy should be sought in the appropriate place, and not through cost awards.
This may be particularly appropriate because the judge may be faced with a variety of factors that arise during the course of a trial involving examination of evidence, credibility of parties and witnesses, and the general tenor of the case.
His opinion that the vesting of a general discretion in the Courts in the area of cost awards is illusory, as evidenced by the application of the English Costs in Criminal Cases Act (98).
