Topic: Adjudication

Adjudication - Wikipedia, the free encyclopedia
Adjudication is the legal process by which an arbiter or judge reviews evidence and argumentation including legal reasoning set forth by opposing parties or litigants to come to a decision or judgment which determines rights and obligations between the parties involved.
Adjudication is a relatively new process introduced by the Government of Victoria in Australia, to allow for the rapid determination of progress claims under building contracts or sub-contracts and contracts for the supply of goods or services in the building industry.
The act covers construction, and related supply of goods and services, contracts, whether written or verbal.

 Adjudication - Common Queries
Adjudication is a statutory procedure by which any party to a construction contract has a right to have a dispute decided by an adjudicator
Usually, the successful party is not required to pay the adjudicator’s fees but should an unsuccessful party refuse to pay the adjudicator’s fee he can lawfully claim the fee from the successful party.
The Adjudicator's Decision is binding on the parties until the dispute is finally decided by arbitration (if provided for in the contract or agreed to), litigation or agreement.

 [No title]
Adjudication generally refers to processes of decision making that involve a neutral third party with the authority to determine a binding resolution through some form of judgment or award.[1] Adjudication is carried out in various forms, but most commonly occurs in the court system.
Adjudication results in win-lose outcomes, leaving little chance the parties will develop a collaborative or integrative solution to the problem, unless the case is settled out of court before the trial.
Court-based adjudication is prohibitively expensive in terms of monetary cost making it impossible for some parties to take their complaints to a court of law.

Adjudication partnerships may be formed for a variety of reasons, including to address a specific problem in the justice system (for example, to develop a much-needed pretrial diversion program) or to form permanent interagency councils or oversight committees that meet regularly to discuss issues or problems.
Notwithstanding fundamental obstacles, adjudication partnerships are proliferating in jurisdictions throughout the United States as criminal justice professionals seek new and more effective solutions to complex problems such as backlogged dockets, crowded jails, and recidivism of drug-addicted offenders.
Most adjudication partnerships have been created through grassroots efforts by local criminal justice leaders who are committed to improving the operation and effectiveness of local criminal justice systems.

Improving Adjudication in the Construction Industry: REPORT OF CONSULTATION AND PROPOSALS
Allowing adjudicators to correct errors in their decisions should reduce the likelihood of a dissatisfied party having to refer the original dispute to an arbiter or the courts and so it is necessary to achieve a reasonable balance when considering the extent to which errors should be corrected.
One respondent thought that legislation should be introduced to provide that adjudicators’ awards might be enforced by grant of decree conform by a court and that the decree should not prevent a review of an adjudicator’s decision nor the granting of an order contrary to the terms of any enforcement decree.
One respondent suggested that as adjudication is increasingly being used in large disputes, the procedure should give the adjudicator sufficient time in which to study the information submitted by the parties, and that this should be enshrined in the legislation.

Contrary to regulation, which requires that a hearing examiner or the chief hearing examiner adjudicate a traffic infraction or dismiss a notice of infraction, the TSA administrator, who is not a designated hearing examiner or the chief hearing examiner, personally decided certain parking tickets.
Generally speaking, an administrative adjudication will be sustained on appeal so long as it is not arbitrary or capricious, contrary to the Constitution, in excess of the agency's jurisdiction, made contrary to statutory or regulatory procedures, or unsupported by substantial evidence on the record.
According to traffic adjudication regulations, requests for parking ticket dismissals should have been forwarded to the Bureau of Traffic Adjudication for review and adjudication by a hearing examiner, the chief hearing examiner, or the mail adjudicator in the manner established by law and regulation.

ADJUDICATION OF WATER RIGHTS -- The Water Facts Group of Washington
The superior court joins all parties in the adjudication proceeding, known and unknown, who claim the right to divert and use water from a particular source; conducts evidentiary hearings through a referee; and issues a decree defining the extent and validity of all claimed rights.
For purposes of this paper, Table 2 has been prepared which adds the date of filing a petition, the date the action was filed by the state in superior court, and the number of months from the date of court filing to the issuance of a decree.
This means that the state procedure should be a comprehensive system "for the adjudication of rights to the use of water of a river system or other source." Considerable flexibility, however, is left to the states in defining what is a "general" adjudication.

The use of Adjudication extends beyond the accepted scope for Arbitration or Litigation in that many smaller disputes can now be dealt within in a relatively fast and cost effective manner, that is not to say that large disputes cannot use Adjudication, they can and do.
