NELA and nearly a dozen other advocacy organizations (including the NAACP and AARP) joined the amicus brief filed by the Lawyers’ Committee for Civil Rights in this Title VII case that was decided in June 2004.
The Court ruled that depending on the circumstances that preceded it, an employer may be held strictly liable when an employee can prove constructive discharge in a hostile work environment case.
NELA member Candace Gorman of Chicago represented the plaintiffs, and in May 2004 the Supreme Court issued a unanimous decision in favor of a uniform federal four-year statute of limitations.
