Federal and Tribal Reserved Water Rights - Winters v. United States - Chehalis River Council
This fact generates much concern on the part of state water administrators and water rights holders who fear that existing water allocation regimes will be disrupted once reserved rights are exercised.
Whereas most western water rights (so-called state-based appropriative rights) have a priority date based on when water was first put to beneficial use, federal reserved water rights have a priority date that goes back at least as far as the date on which the lands were set aside.
Once reserved water rights have been quantified, such rights may be used for purposes different from those for which.

 Plenary Power and Constitutional Outcasts
The racist baggage of states' rights — the indelible image of George {1596} Wallace standing at the school house door and contemplation of the modern social and political landscape absent federal intervention — alone might be sufficient to sustain minority adherence to plenary power constitutionalism that reduced states' rights to rubble.
"Those powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people." U.S. Const.
Serious evaluation of the states' rights construction raises extremely troublesome questions that advocates of the position have not discussed — e.g., state acquisition of and preparations with artillery, air power, and weapons of heavy destruction whose control is concentrated in a handful of state officials.

 States' Rights
The legal basis for the Southern call for nullification of the tariff laws was firmly rooted in states'-rights principles.
The principle of states' rights and state sovereignty eventually led the Southern states to secede from the central government that they believed had failed to honor the covenant that had originally bound the states together.
Northern proposals to abolish or restrict slavery- an institution firmly protected by the Constitution- escalated the regional differences in the country and rallied the Southern states firmly behind the doctrine of states' rights and the sovereignty of the individual states.

 State - Encyclopedia.WorldSearch
While libertarians argue for a small or "minimal" state, which simply protects property rights and enforces individual contracts, the New Deal or social liberals argue that the state has a greater positive role to play, given the problems of market failure and gross inequalities in the distribution of income and wealth inside a capitalist system.
In casual language, the idea of a "state" and a "country" are usually regarded as synonymous, although some speakers, notably in the United States, make efforts to only use the terms "country" or "nation" to refer to sovereign entities.
The "state" can thus also be defined in terms of domestic conditions, specifically the role of the monopolization of the legitimate use of force within a country.

Op-Ed: Court Shoots Down Collective Rights Theory
The Preamble declares that the Constitution is ordained and established by 'the People of the United States.' The Second Amendment protects 'the right of the people to keep and Bear arms,' and the Ninth and Tenth Amendments provide that certain rights and powers are retained by and reserved to 'the people.'
So while gun owners celebrate the acknowledgment of an individual right, the fact that a court at the same time ruled that such a right could, under certain circumstances, be infringed is unsettling.
Timothy Emerson was not convicted of any crime before losing his gun rights, something the Court, albeit tepidly, agreed with.

States Rights, One of the Causes of the Civil War
State rights and strict construction were usually the arguments of the party out of power (and so they were to he throughout American history).
The 1860 South Carolina Declaration of the Causes of Secession quoted the states 1852 declaration, which said that "the frequent violations of the Constitution of the United States by the Federal Government, and its encroachments upon the reserved rights of the States," would justify the state in withdrawing from the Union.
When dealing with the subject, the Federal government must act merely as a trustee for the states and must give effect to their laws, particularly the laws respecting slavery State rights was no longer just a defense of local self-determination; it had become a means of imposing a states laws on people outside the state.

Libertarians and States Rights by Marcus Epstein
Libertarians support States Rights because they restrict the power of the federal government, not because they wish to empower state governments.
The point is that the Constitution, properly interpreted, gives states primary jurisdiction over the federal governmentÂ’s in most areas, and that they possess many legal rights, such as secession and nullification.
The 10th Amendment added that "powers not delegated to the United States Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
