 NodeWorks - Encyclopedia: Amistad
In 1841, a federal trial court found that the initial transport of the Africans across the Atlantic had been illegal and that they were not legally slaves but free; after being affirmed on March 9, 1841 by the United States Supreme Court on appeal, the Africans travelled home in 1842.
John Quincy Adams, congressman from Massachusetts and former President of the United States, agreed to argue the case before the high court.
Their main argument before the District Court was that a treaty between Britain and Spain of 1817 and a subsequent pronouncement by the Spanish government had outlawed the slave trade across the Atlantic.

An account of the Amistad Case.
The Amistad civil trial began on November 19, 1839 in Hartford.
Justice Story, speaking for the Court, said that the Amistads were "kidnapped Africans, who by the laws of Spain itself were entitled to their freedom." As justification for the Court's decision, Justice Story relied largely on the narrower arguments of Roger Baldwin, rather than the "interesting remarks" of John Quincy Adams.
The Amistads, strangers in a strange land, were not without their problems.

Cinque was not at the Supreme Court arguments, but remained in Connecticut.
Isabella II writes numerous letters to the United States protesting that the slaves must be returned, and Van Buren is counseled that John C. Calhoun is threatening that Civil War may be the outcome if the case is not resolved in a pro-slavery fashion.
The Secretary of State Forsyth made arrangements for the Amistad slaves at that trial's conclusion, no matter whether the district court trial found them to be either African or Cuban in origin, to be placed on the U.S. navy vessel Grampus and returned to Cuba (p.

A Brief Historical Note on Slavery and the Amistad: In 1808, the importing of slaves to the United States was made illegal (The previous year, in 1807, the transporting of slaves was made illegal throughout the British Empire, including from England’s African colonies).
A Brief Summary of Legal Positions that were Presented in the Amistad Case: District Attorney Holabird: He prosecutes Cinque and his colleagues for the murder of the Spanish crew of the Amistad, and he probably would have agreed to have them returned to the Spanish "owners," Ruiz and Montes.
It is important to note that the Amistad case was a symbolically important development in American history, in that it showed how bitterly divided the United States was at the time.

Rob Waring: Amistad (Van Buren's Folly)
The crew of the United States warship that recaptured La Amistad claims a one-third salvage interest in the vessel, under a maritime law incentive scheme that rewards enterprising seamen, even those in government employ, for retrieving lost property.
In a cramped, overcrowded federal district courtroom in Connecticut, a succession lawyers appears, each holding up writs and pleas and insisting on being heard, until there are five parties present, each claiming to have international treaties on their side.
The United States supports the Spanish, but argues the slaves should be executed as murderous mutineers, giving a criminal flavor to the admiralty proceedings.

An attorney for the United States government appeared before the court and presented this request.
Spain argued that, since the Amistad was rescued by a U.S. government-owned armed ship, the United States was obligated under international treaty to return the ship and its cargo to the Spanish owners.
The district court judge ruled that the slaves were free men, and ordered them released from prison.

 Boxoffice Magazine: [Debbie Allen]
In setting them free, the Supreme Court did not find slavery illegal in the U.S. but ruled instead that the Africans were not legal property of their captors and that they had a right to self-defense.
Calling the captives in Amistad "slaves," however, is a misnomer.
Allen also points out that the denouement hardly was unambiguously happy: 18 of the captives died before being liberated, Cinque returned home to Sierra Leone to find his family vanished, and the unresolved slavery issue continued to fester until the Civil War erupted.

The Supreme Court had been appealed to after both a district court in Hartford, Connecticut, and a higher court found that the Africans aboard the Amistad were freeborn and deserved to be allowed to return to Africa rather than be treated as merchandise belonging to Ruiz and Montez.
The treaty with Spain never could have intended to take away the equal rights of all foreigners, who should contest their claims before any of our courts, to equal justice; or to deprive such foreigners of the protection given them by other treaties, or by the general law of nations.

The review of Amistad by Robert L. Waring that we discuss above is part of a site, Picturing Justice, that posts thoughtful and well-informed reviews concerning movie depiction of the legal system.
We, and everyone, already agree completely that slavery and the evolution of the American system of justice are important issues that demand a serious and human response.
Robert L. Waring has written a review, posted on the Web site Picturing Justice, that is clear, perceptive, and intelligently written and with which we agree on all the issues except the main one.

After seizing Amistad, whose name is Spanish for "friendship," Gedney had the ship taken to New London, where, because slavery was still legal in Connecticut, he could claim salvage on the ship and her cargo, including the slaves, who had been purchased for $450 each in Havana.
In the opening round of legal proceedings, Ruiz and Montes argued that their property should be handed over to the Spanish consul and that the slaves be charged with murder and mutiny in a Spanish court.
Amistad was returned to Cuba, but the legal entanglements did not end there: although Congress voted $70,000 to be paid to Spain in 1844, reparations were not paid until 1860.

While the Amistad case cannot be viewed as a legal or political turning point in the struggle against slavery in the United States, it was a victory for the abolitionists, providing a further demarcation of the forces for and against slavery.
He had become interested in the Amistad case when it was tried in the District Court, but Tappan had rejected his initial offer of assistance.
The case went before the Supreme Court on February 22, 1841; Adams considered the date of George Washington's birthday a good omen.

The two survivors of the Amistad crew demand that their 'property' be returned to them, and argue that they have not broken any anti-slavery laws with their contention that the slaves are second-generation slaves from Cuba.
Regardless of the outcome of this real world courtroom drama, "Amistad" is a compelling, and most likely Oscar-bound, historical courtroom drama that sheds light on an overlooked period in American history between the Declaration of Independence and the American Civil War.

In its own day, the Amistad case generated tremendous publicity.
The case broke little new legal ground, though as Nanette Roberts of the Amistad Research Center at Tulane University notes, the court did declare that the Africans had equal rights to equal justice before American courts.
Moreover, the case led directly to the creation of the American Missionary Association, a key abolitionist group that after the Civil War was instrumental in founding black schools and colleges.

 Amistad (1997): Reviews
When the ship is seized, the captives are brought to the United States where an enthralling courtroom battle ensues that captures the attention of the entire nation while confronting the very foundation of the American justice system.
Dwarfed by the enormity of what it means to illustrate, the diffuse Amistad divides its energies among many concerns: the pain and strangeness of the captives' experience, the Presidential election in which they become a factor, the stirrings of civil war, and the great many bewhiskered abolitionists and legal representatives who argue about their fate.
Hopkins uncannily projects Adams's suppressed agonies as well as his querulousness, his zest for scholarship as well as his zest for political intrigue, his pragmatism as well as his idealism.
