British nationality law - Wikipedia, the free encyclopedia
Thus the British Nationality Act 1948 provided for a new status of Citizen of the United Kingdom and Colonies (CUKC), consisting of all those British subjects who had a close relationship (either through birth or descent) with the United Kingdom and its remaining colonies.
A person became a British National (Overseas) by making a valid application on the prescribed form to the British authorities to be registered for that nationality, and applicants only became a British National (Overseas) when their application was approved and duly registered by the Home Secretary.
Article 4(1) of the Order provided that on and after 1 July 1987, there would be a new form of British nationality, the holders of which would be known as British Nationals (Overseas).

Scotsman.com News - Latest News - Sex-Charge Islanders 'Not British'
Mutineers who burned the British navy ship Bounty at Pitcairn Island in 1790 ceased being British subjects when they did it, a lawyer for seven of their descendants said today in an argument key to their court battle against sex crime charges.
“Each and every one was illegitimate because there were no marriages according to British law, and they could not be regarded as British subjects,” Cook told the court.
They are asking the Pitcairn Court of Appeal – being held in Auckland, New Zealand for logistical reasons – to overturn a lower court’s ruling that British laws apply to them.

 Welcome to The American Presidency
Britain's constitutional arrangement adopted various protections for British subjects in the Magna Carta (1215), the Bill of Rights of 1689, and English common law, while many of the colonial charters also contained protections for various customary rights.
The first ten amendments to the U.S. Constitution guaranteeing certain rights to the people are known collectively as the U.S. Bill of Rights.
None of these proclamations of rights could prevail against a legally omnipotent act of Parliament, however.

 ACM Hot News: Loyal Subjects
But after 1 May 1987, all reference to the status of “British subject”; - for the purposes of Australian law - disappeared under the Australian Citizens Amendment Act, 1984 (Cth).
So we were British subjects under British law until 1981, and under Australian law until 1987.
I think this states the correct legal and constitutional position about the use of the term “subject of The Queen”:-

Immigration & Nationality Directorate - BN3: Information about British subject status
The law covering British subject status is in the British Nationality Act 1981 and the Regulations made under it.
A person is normally regarded as settled in the United Kingdom or a British overseas territory if he or she is ordinarily resident there without being restricted, under the immigration laws, as to how long he or she can stay there.
The Home Secretary can register any child under 18 as a British subject but very rarely agrees to registration.

Asia Times: SRI LANKA: THE UNTOLD STORY
The United Kingdom legislation, the British Nationality Act 1948, created the status of British subject: Citizen of the United Kingdom and Colonies (BS/CUKC) for all those whose connection was with the United Kingdom itself or with a place which, on 1 January 1949, was still a colony.
The Act also provided for two categories of persons to remain "British subjects" only (not CUKCs).
The term "Commonwealth citizen" no longer has the same meaning as "British subject" although persons connected with the Republic of Ireland, India or Pakistan who were British subjects under the 1948 Act (see paragraph 5 above) retain that status under the 1981 Act.

The Electronic Journal of Australian and New Zealand History:
In May 1839, Normanby wrote to the British Attorney General, recommending a cession of sovereignty, but also, outlining the fact that the practice and jurisdiction of British government in New Zealand would be limited to the rule over British settlers.
In August 1839, a letter from Palmerston, the British Foreign Secretary, revealed that the basis of Britain's intervention in New Zealand lay in the fact that specifically British settlement in the colony '...indispensably requires the check of some contending authority'.(4) No mention was made of such authority extending its jurisdiction to Maori.
Hobson's Proclamations of 30 January 1840 referred, significantly, to the existing and prospective settlement of British subjects in New Zealand, as though to provide some constitutional safety-net should the plans for the Treaty not eventuate.

The High Court and Deportation Under the Australian Constitution
Allegiance to the Crown, and the monarch who was for the time being its visible and personal embodiment, was the common element of nationality shared by all British subjects, including those born in Australia.
Putting legal considerations to one side, it is unfortunate from the perspective of Australia's national development that some members of the High Court allow discrimination in favour of 'British subjects' (whatever the exact extent of that phrase) in relation to 'alien' status.
The fate of the British migrant who has lived in Perth for the last 26 years will depend on the High Court's decision in several similar matters due to be heard in mid-2003.

The British government may not sign treaties or carry out any other action that might result in giving away its power or sovereignty to any other country without the consent of 66% of the entire British electorate in two separate ballots held five years apart.

The Monarch shall call a policy ballot on any subject or subjects where she has reason to believe the major wishes of her subjects are being ignored by elected politicians.

Subjects and Citizens:History of Australian Citizenship
According to the British legal heritage, houses and homes could not be entered by police authorities without a warrant from a court.
For example, as British subjects, Australian colonists called upon the right to protection from arbitrary arrest and imprisonment.
The early precedents that gave certain legal rights to both convicts and emancipists meant that the exercise of political power was able to be challenged as to its legality in the colonial courts.

THE UNITED STATES IS STILL A BRITISH COLONY
Men in free governments are subjects as well as citizens; as citizens they enjoy rights and franchises; as subjects they are bound to obey the laws.
In exercising this power, Congress is not subject to the same constitutional limitations, as when it is legislating for the United States.
At the time of conquest the laws of the conquered state are subject to change or removal, which means the law no longer lies with the American people through the Constitution, but lies with the new sovereign.

COMPERE: Republicans may still be licking their wounds in the wake of last November's referendum, but they can console themselves with one fact - retaining the Queen as our head of state may mean that in the near future Australians may find British immigration procedures less of a bugbear.
As you fiddle with clumsy landing cards and endure the third degree from gruff British officials, you happen to glance sideways seeing citizens of the United Kingdom and the 14 other European Union countries breezing through Immigration, merely showing the covers of their passports.

Under UK law, from 1949 to 1982 the terms 'British subject' and 'Commonwealth citizen' were interchangeable.
The British Nationality Act 1981, which came into force on 1 January 1983, ended the use of the term 'British subject' to refer to Commonwealth citizens.
People from the UK became British citizens, and there is no reference made to British citizens being also British subjects.
