Child custody - Wikipedia, the free encyclopedia
Child custody and guardianship are legal terms which are sometimes used to describe the legal and practical relationship between a parent and his or her child, such as the right of the parent to make decisions for the child, and the parent's duty to care for the child.
Prior to the Uniform Child Custody Jurisdiction and Enforcement Act, when parents sought an advantage in a custody tug-of-war, they would move to a "friendly" jurisdiction (that is, a region with a history of rulings favorable to their position).
Following ratification of the United Nations Convention on the Rights of the Child in most countries, terms such as "residence" and "contact" (known as "visitation" in the United States) have superseded the concepts of "custody" and "access".

 Child Custody Frequently Answered Questions
Child custody determinations are made by state courts, and each state will generally apply its own law in making a child-custody determination.
The essence of a custody dispute is that, when divorcing parents are unable to agree on arrangements for the custody of their child, the court must make a decision for them.
Because the law of child custody varies from state to state, a person who may have valuable rights affected by such laws should consult with an attorney who specializes in such matters.

The psychologist should be impartial regardless of whether he or she is retained by the court or by a party to the proceedings.
Psychological data and expertise, gained through a child custody evaluation, can provide an additional source of information and an additional perspective not otherwise readily available to the court on what appears to be in a child's best interest, and thus can increase the fairness of the determination the court must make.
Particular competencies and knowledge are required for child custody evaluations to provide adequate and appropriate psychological services to the court.
