Codification - Wikipedia, the free encyclopedia
Codification in common law and civil law jurisdictions
In law, codification is the process of collecting and restating the law of a jurisdiction in certain areas, usually by subject, forming the legal code.
The official codification of Federal statutes is called the United States Code.

LINDSAY FARMER Reconstructing the English Codification Debate: The Criminal Law Commissioners, 1833-45 Law and ...
Advocates of codification in England bemoan the partial or incomplete modernization of the common law and the institutions of law and government, just as the conventional accounts of European codification posit an indissoluble link between the reform and codification of the penal law and the formation of the modern nation-state.
We see here the crystallization of opposition to codification of the criminal law, as well as the hardening of the distinction between those types of consolidation that were to be considered permissible and those that were regarded as a threat to the common law.
The apparent failure of the codification project in England would suggest that the English law is, in some sense, premodern and anachronistic, lacking certain ideas and institutions and possessed of a lingering and inexplicable attachment to the arcane rituals of common law adjudication.

 Codification Legislation
Positive law codification is the process of preparing and enacting, one title at a time, a revision and restatement of the general and permanent laws of the United States.
Positive law codification bills prepared by the Office do not change the meaning or legal effect of a statute being revised and restated.
When this project is completed, all the titles of the Code will be legal evidence of the general and permanent laws and recourse to the numerous volumes of the United States Statutes at Large for this purpose will no longer be necessary.

Official codification means the bringing together of a basic piece of legislation and all its amendments in a single new act which repeals the acts to be codified without however changing the substance of this legislation.
It is the subject of a special accelerated legislative procedure agreed with the European Parliament and the Council in December 1994 (Official Journal of the European Communities, C 102, 4.4.1996, p.

A "codification" is also to be distinguished from an unofficial "compilation" that constitutes a collection of legal rules (perhaps with added commentary or structure) but that does not itself have the force of law.
However much enthusiasm the codification movement was able to generate at the national level, legal codification in nineteenth-century America would have to be, in the end, largely a state-by-state process.
Except for the most general of grounds for espousing codification -- the advisability in principle of bringing more control and clarity to the mounting volume of case law and statutes -- there was no common thread in the movement, no single theory sufficiently compelling to translate proposals into effective action.

Codification will also compliment the modernisation work under the Government's Programme of Better Regulation, by addressing those pre 1922 criminal law statutes which continue on our statute book despite the difficulties in accessing these texts in our modern technological era.
Significantly the Group has also tackled the issue of the common law and undertaken a sensitive analysis which acknowledges the flexibility of the common law but at the same time questions the appropriateness of this system in the light of the current dynamics of criminal law.
Finally the Group recognised that a Criminal Code cannot be exhaustive and recommend that certain areas of the criminal law including sentencing and criminal procedure be outside the code possibly for the development of their own individual codes.
