Topic: Confidentiality

Confidentiality - Wikipedia, the free encyclopedia
Confidentiality has been defined by the International Organization for Standardization (ISO) as "ensuring that information is accessible only to those authorized to have access" and is one of the cornerstones of Information security.
California is famous for having one of the strongest duties of confidentiality in the world; its lawyers must protect client confidences at "every peril to himself or herself." Until an amendment in 2004, California lawyers could not breach their duty even if they knew that a client was about to commit murder.
In those jurisdictions in which the law makes provision for such confidentiality, there are usually penalties for its violation.

 Understanding Confidentiality Agreements
Confidentiality agreements, sometimes called secrecy or nondisclosure agreements, are contracts entered into by two or more parties in which some or all of the parties agree that certain types of information that pass from one party to the other or that are created by one of the parties will remain confidential.
The point is that the confidentiality agreement should specifically state the starting date for the confidentiality time period in order to avoid any ambiguity.
Therefore, before signing a confidentiality agreement, it would be prudent to investigate the recipient's practices regarding maintaining secrecy of its own information.

 AMA (Legal Issues) Patient Confidentiality
A breach of confidentiality is a disclosure to a third party, without patient consent or court order, of private information that the physician has learned within the patient-physician relationship.
Although current law in this area has been referred to as "a crazy quilt of state and federal law," protecting patients' confidentiality is the law of the land.
The legal basis for imposing liability for a breach of confidentiality is more extensive than ethical guidelines, which dictate the morally right thing to do.

Frequently Asked Questions (FAQs) on Certificates of Confidentiality
No, a Certificate of Confidentiality protects investigators and institutions from being compelled to release information that could be used to identify study participants in any civil, criminal, administrative, legislative, or other proceeding, whether at the federal, state, or local level.
Generally, an application for a Certificate of Confidentiality is submitted after the Institutional Review Board (IRB) responsible for its review approves the research project (because IRB approval or approval conditioned upon issuance of a Certificate of Confidentiality is a prerequisite for issuance of a Certificate).
The authorized institutional official is the individual named by the applicant organization who is authorized to act for that organization and assumes on behalf of the institution the obligations imposed by assurances as well as obligations imposed by the Federal laws, regulations, requirements and other conditions that apply to grant applications and awards.

We have seen that confidentiality is an ethical issue that is not easily resolved, particularly when we consider the notion that there should be 'blanket' laws meant to cover every type of confidentiality dispute.
However, the principle of confidentiality is not absolute; ethical, legal and statutory obligations may permit physicians to disclose information.
Breaching confidentiality has permissive circumstances, as long as certain rules are followed to avoid legal sanctions.

Novel techniques for confidentiality are interesting in part because of the current debate about cryptographic policy as to whether law enforcement should be given when authorized surreptitious access to the plaintext of encrypted messages.
As a consequence of the existence of chaffing and winnowing, one can argue that attempts by law enforcement to regulate confidentiality by regulating encryption must fail, as confidentiality can be obtained effectively without encryption and even sometimes without the desire for confidentiality by the two communicants.
Indeed, the process of authenticating packets and then adding chaff achieves confidentiality, and so qualifies as encryption by anyone who uses a definition of encryption that is so broad as to include all techniques for achieving confidentiality.

If it's an agreement where only one side is providing confidential information, then the disclosing party can be referred to as the disclosing party and the recipient of the information can simply be referred to as the recipient.
The parties to the agreement is usually a straightforward description set forth at the beginning of the contract.
