After the Circuit Court of Cook County held Section 11-501.8 to be unconstitutional on its face, finding that the administrative proceedings violated the equal protection and due process rights of drivers under the age of 21, the state appealed directly to the Illinois Supreme Court.
Section 11-501.8 of the Illinois Vehicle Code, commonly referred to as the zero tolerance law, provides that any driver under the age of 21 who tests positive for the presence of alcohol or refuses testing upon a police officer’s proper request is subject to summary suspension of his or her driving privileges.
Such a presumption charges the court with upholding a statute’s validity if reasonably possible and forces the party challenging a statute to bear the burden of clearly establishing why the statute is unconstitutional.

Former New Hampshire Gov. Craig Benson (R) in June 2003 signed the measure (HB 763), which would have required physicians in the state to notify by certified letter a parent or guardian of a minor who is seeking an abortion at least 48 hours before performing the procedure.
Under the measure, parents would not have been able to forbid the procedure and the notification requirement could have been bypassed by a judge or if a doctor determines that the minor's life is in danger.
Ayotte says the court should not issue injunctions preventing laws from taking effect unless "no set of circumstances exists under which the act would be valid," according to the New York Times.
