 Seanad Éireann - Volume 105 - 13 September, 1984 - Criminal Justice Bill, 1983: Second Stage (Resumed).
They are not related to justice in the terms of the Criminal Justice Bill.
The Bill, which is a review of criminal procedure, is both necessary and timely but to make it workable and effective specific action under a number of headings is required by the Minister for Justice and the Government.
The changes in the criminal law that we are proposing go through all the different procedures that are mentioned, detention for a new purpose, penalties for withholding information or being unable to explain oneself, changes in the traditional civil liberties in relation towards silence and a greater use no doubt of confessions in court.

 Seanad Debates - Criminal Justice bill
That period of detention was already permitted under the Criminal Justice Act, 1984.
Certain sections of the Criminal Justice (Drug Trafficking) Act - primarily relating to extra detention powers for the Garda -will, under the terms of the Act, cease to be in operation from 9 September 1997 unless a resolution is passed by both Houses of the Oireachtas extending their operation.
The debate on the Criminal Justice Bill, to which I referred earlier, will be one of those opportunities.

 Explanatory memo of the Criminal Justice Bill 2004
The Bill proposes a number of amendments to the criminal law, particularly in the area of criminal investigations, which will enhance Garda powers in tackling crime and will generally improve the efficiency and the effectiveness of the criminal justice system.
Section 79 of the Courts of Justice Act 1924 provides for three bases of jurisdiction for the District Court i.e.
amends section 34 of the Criminal Procedure Act 1967 to provide that the Attorney General or the Director of Public Prosecutions, if he or she is the prosecuting authority in the trial, may on a without prejudice basis, refer a question of law arising during the trial to the Supreme Court for determination.

 Criminal Justice 'Reform' Act
The bills together are often referred to as the "Criminal Justice Reform Act," or more popularly the "Truth in Sentencing Act." The legislation in fact does reform the criminal justice system -- for the criminal -- but brings neither comfort nor truth to the public.
The criminal justice legislation being debated includes House Bill 1213, along with House Bill 1225, the "trailer bill" that was intended to clean up all of the problems in HB 1213.
The bill clearly states, "The policy of this state is to sentence persons convicted of felonies pursuant to sentencing matrices." The sentencing matrices define the potential term of confinement, and place of confinement, by how many correctional beds are available.

Instead of introducing the Bill as a Firearms (Amendment) Bill, Roy Jenkins chose to use the Criminal Justice Bill as the vehicle for the legislation.
A separate bill would probably have attracted considerable opposition and the Criminal Justice Bill was already a contentious piece of legislation.
As a result opposition to Part V of the bill, which introduced licenses for shotguns, was diluted.

 McDowell publishes Criminal Justice Bill 2004
The Bill presents a comprehensive package of anti-crime measures which will enhance the powers of the Gardaí in the investigation and prosecution of offences and generally provide for improvements to the operation of the criminal justice system.
In preparing the Bill the Minister paid particular attention to getting the balance right between maintaining the rights of the individual and at the same time ensuring the optimum protection of society by ensuring adequate criminal law measures are available to deal with offenders.

(1) At any sitting of a child justice court no person may be present unless his or her presence is necessary in connection with the proceedings of the child justice court or unless the presiding officer has granted him or her permission to be present.
(5) The child justice court must protect a child from hostile cross-examination where the cross-examination is prejudicial to the well-being of the child or the fairness of the proceedings.
(3) If the child justice court grants an application for joinder of trials, the matter must be transferred to the court in which such person is to appear.

Last year, the state Department of Justice received funding to hire forensic polygraph examiners to assist local law enforcement authorities in the apprehension and prosecution of sex offenders.
The state provides detailed information to local law enforcement agencies prior to the release of high-risk sex offenders, and authorizes those agencies to provide specific warnings and information about such offenders to schools and individuals determined to be at risk from their presence in the community.
If the court issues an order enforcing the agreement and a party violates that order, the court may order monetary, civil contempt, or criminal sanctions to enforce compliance.

The legislation proposes an extension of the maximum period of time for which gardaí can detain a suspect before he or she must be charged or released and would give the DPP greater powers to appeal the leniency of sentences handed down by the courts.

 American Civil Liberties Union
The U.S. Supreme Court ruled a Michigan law that denied legal representation to poor people unconstitutional.
The case began after the state legislature passed a law forbidding judges from appointing counsel to help indigent criminal defendants with appeals.
Legislation was introduced to the Senate this past week authorizing the FBI to issue its own "administrative subpoenas" and search orders.
