Digital Millennium Copyright Act - Wikipedia, the free encyclopedia
The Digital Millennium Copyright Act (DMCA) is a controversial United States copyright law.
DMCA Title I has two major portions, one of which includes works covered by several treaties in US copy prevention laws and gave the title its name and the other which is often known as the DMCA anti-circumvention provisions.
Passed on May 14, 1998 by a unanimous vote in the United States Senate and signed into law by President Bill Clinton on October 28, 1998, the DMCA amended title 17 of the US Code to extend the reach of copyright, while limiting the liability of Online Providers from copyright infringement by their users.

 ALA Guide to the DMCA
The DMCA treats works published in the United States or a treaty party within 30 days after publication in a non-U.S., non-treaty party as first published in the United States or a treaty party for purposes of conferring protection.
In determining whether this exception is applicable, the DMCA requires the court to consider whether the information derived from the security testing was used solely to improve the security measures or whether it was used or maintained so as not to facilitate infringement.
The DMCA permits circumvention for any lawfully authorized investigative, protective, or intelligence activity by or at the direction of a federal, state, or local law enforcement agency, or of an intelligence agency of the United States.

 Copyright Strikes Back Linux Journal
Under the terms of the 1998 Digital Millennium Copyright Act (DMCA), the ISP is under a positive obligation to remove the potentially infringing material immediately, even though no court of law has determined that it does, in fact, infringe on the plaintiff's copyright.
In cases of copyright infringement, the DMCA radically shifts the burden of proof to alleged infringers--and in most cases, the mere accusation is sufficient to suppress unwanted material.
In addition to the traditional statutory damages assessed in cases of copyright infringement, the DMCA establishes criminal sanctions of up to five years of imprisonment (doubled in the case of repeat offenders) and fines of up to--get this--$500,000.

FAQ about DMCA Safe Harbor Provisions -- Chilling Effects Clearinghouse
The DMCA provides a safe harbor to information location tools that comply with takedown notices, but it is not settled whether they would be liable for copyright infringement if they did not use the safe harbor.
The DMCA subpoena provision does not apply to requests for the identities of users of ISP conduit 512(a) services, but only to users of hosting or linking, for which a takedown may be sent under 512(c)(3)(A).
Codified as section 512 of the Digital Millennium Copyright Act (DMCA), this new law exempts on-line service providers that meet the criteria set forth in the safe harbor provisions from claims of copyright infringement made against them that result from the conduct of their customers.

Mindjack - the beat of digital culture
The DMCA "propertizes" intellectual property and copyright, in Lessig's terms, by reducing the panoply of IP usage to a yes/no checkbox on a licensing agreement dialog box.
The DMCA largely assumes that libraries' digital holdings do not hew to this principle, and thus may be compelled to re-purchase each user's use of such materials.
The DMCA may mitigate this openness, in its progressive unfolding in courts and lawsuits.

In summary, the Copyright Office should heed the advice of the library associations, the cryptographers, the non-proprietary software developers, academics, and the civil liberties groups and construe the DMCA narrowly to provide adequate protections for the interests (other than the copyright industry) represented in the copyright bargain.
Therefore, all classes of works must be exempt from the general circumvention prohibition when the purpose for the circumvention is to engage in a lawful fair use of a work.

DMCA challenge to be considered this week
The Digital Millennium Copyright Act, better known as the DMCA, is a travesty of law.
In other words, it might be legal, under copyright laws, for you to copy or access purchased content, but the DMCA prohibits, and makes criminal, the activity nonetheless if you bypass a technology control to perform the legal activity.
Even if you have complete and utter legal rights to something, those rights are trashed if the content you have rights to is copy-protected by even the more infantile of copy schemes.
