Due process - Wikipedia, the free encyclopedia
Following the Civil War, the Fourteenth Amendment's due process clause allowed substantive due process interpretations to be urged on the Supreme Court as a limitation on state legislation.
Due process has also been interpreted as placing limitations on laws and legal proceedings in order to guarantee fundamental fairness, justice, and liberty.
Due process of law is a legal concept that ensures the government will respect all of a person's legal rights instead of just some or most of those legal rights when the government deprives a person of life, liberty, or property.

 CITES BY TOPIC: due process
Due process of law in each particular case means such an exercise of the powers of the government as the settled maxims of law permit and sanction, and under such safeguards for the protection of individual rights as those maxims prescribe for the class of cases to which the one in question belongs.
Without due process of law all lawyers are out of work, the foundations of the courts are undermined, they have no power, and the Law of the Jungle rules, the Societal Contract is Officially Dead, and the Courts ruling will be the Death Certificate.
The concept of “due process of law&; as it is embodied in the Fifth Amendment demands that a law shall not be unreasonable, arbitrary, or capricious and that the means selected shall have a reasonable and substantial relation to the object being sought.

Due course of law: This phrase is synonymous with "Due Process of Law" or "Law of the Land" and means law in its regular course of administration through courts of justice.
Due process of Law is secured against invasions by the Federal Government by this Amendment (5th) and is safeguarded against state actions in identical words per the Fourteenth Amendment.
Reasonable access to the courts is a right (secured by the Constitution and the laws of the United States), being guaranteed as against state action by the due process clause of the fourteenth amendment.

Due Process of Law by Jacob G. Hornberger
Habeas corpus is a process that entitles a person held in custody to file a petition in court formally requesting the court to summon the accused and his custodian to court where the custodian will be required to show the reason he is detaining the petitioner.
The core procedural requirements of due process of law were “notice” and “hearing.” An accused had the right, the courts held, to be advised of the nature of the offenses for which he was being charged.
The other essential part of due process was “hearing” – the right of the accused to be heard, which meant, in a criminal case, a trial.

Lopez, the seminal case establishing the due process rights of students in public school disciplinary proceedings, the Supreme Court held that students had a property interest in education that required minimal due process protections before any disciplinary suspension could be imposed.
Under the due process clause of the Fourteenth Amendment states may not deprive any person of life, liberty, or property without due process of law.
To the contrary, the Court allowed that the Due Process clause is practical; thus, depending upon the nature of the case, more formal procedures may be required "in unusual situations, although involving only a short term suspension...." Id., 419 U.S. at 584.

 Due Process Issues
The phrase "due process of law" was first used in England sometime during the 13th or 14th century as synonymous for "law of the land", hence, it was made part of the common law and given a natural law interpretation.
Due process generally refers to the regularity, fairness, equality, and degree of justice in both procedures and outcomes.
The closest thing to substantive due process in the whole of criminal justice procedure is the standard of proof, and that's only because beyond a reasonable doubt is a tough standard.

The Sixth Amendment, which is applicable to the states through the Due Process Clause of the Fourteenth Amendment, see In re Oliver, 333 U.S. 257, 273-74 (1948), guarantees a criminal defendant a fundamental right to be clearly informed of the nature and cause of the charges against him.

The Fifth Amendment (http://www.law.cornell.edu/constitution/constitution.billofrights.html#amendment) says to the federal government that no one shall be "deprived of life, liberty or property without due process of law." The Fourteenth Amendment (http://www.law.cornell.edu/constitution/constitution.amendmentxiv.html), ratified in 1868, uses the same eleven words, called the Due Process Clause, to describe a legal obligation of all states.
If the courts stretched Fourteenth Amendment “due process” to apply the Bill of Rights to the states, they stretched Fifth Amendment “due process” to require the federal government to afford equal protection of the laws.
The right to a jury trial, to take just one example, means the same in state and federal courts; there are no differences about the number of jurors required, whether they have to be unanimous in their verdicts, and so forth.

Due process, in the context of the United States, refers to how and why laws are enforced.
In the Magna Carta, due process is referred to as "law of the land" and "legal judgment of his peers." Some state constitutions continue to use these phrases.
The reference in the 14th Amendment extends protection of due process to all state governments, agencies, and courts.

 THE LITTLE WORD "DUE"
Due process of law refers to legal proceedings that are owed according to law.
Therefore, the Due Process Clause could not possibly have been intended as a prohibition against federal laws (such as the Fugitive Slave Clause) that were widely recognized in 1788 to be contrary to all principles of liberty and justice.
In other words, if the Court were to acknowledge that "due [page 35] process of law" does not pledge "due laws," [83] then many of the individual rights that the Court has sought to protect using the Due Process Clause would still be protected without additional constitutional amendments.

The Due Process Clause of the Fourteenth Amendment, adopted in 1868, states "nor shall any State deprive any person of life, liberty, or property, without due process of law.

 THE DUE PROCESS CLAUSE
Other constitutional provisions aside from the Due Process Clause give additional procedural safeguards; for example, the Sixth Amendment confers a right to jury trial in criminal cases, the right to appointed counsel if one is indigent, and a right to confront witnesses against oneself.
The Supreme Court has never said that due process requires the states to honor the Bill of Rights as a whole.
The Fourteenth Amendment’s Due Process Clause (which does apply to the states) has been interpreted to make nearly all of the Bill of Rights guarantees applicable to the states — these individual guarantees are "incorporated" into the Bill of Rights.

The ''vested rights'' jurists thus found in the ''law of the land'' and the ''due process'' clauses of the state constitutions a restriction upon the substantive content of legislation, which prohibited, regardless of the matter of procedure, a certain kind or degree of exertion of legislative power altogether.
Scope of the Guaranty.--Standing by itself, the phrase ''due process'' would seem to refer solely and simply to procedure, to process in court, and therefore to be so limited that ''due process of law'' would be what the legislative branch enacted it to be.
The term ''law of the land'' was early the preferred expression in colonial charters and declarations of rights, which gave way to the term ''due process of law,'' although some state constitutions continued to employ both terms.
