 EU Competition Law Takes Effect in January
Hungary’s competition law was broadly welcomed in last year’s European Commission country report, with the qualification that tax incentives must be altered to conform to EU law.
This being the case, EU competition law allows the FDI recipient country to reimburse as much as 50pc of investment costs.
From January 1, 2003 EU law will be fully implemented with the proviso that concessions granted before then will remain, the government says.

 Competition Law Bulletin - First successful claim in the UK for damages under EU competition law
The possibility of claiming damages for breach of competition law has been discussed for many years and, although there have been a number of out of court settlements, this judgment marks the first successful action of its kind in the UK.
The Court of Appeal's judgment of 21 May 2004 in the case of Bernard Crehan v Inntrepreneur Pub Company is the first successful claim in the UK for damages for breach of competition law.
This is a pre-Enterprise Act 2002 case, but the judgment brings into sharp focus the provisions of that Act which expressly allow for the bringing of actions for damages caused by breach of competition law.

The Competition Law also applies to bodies of the state administration, municipalities and local government institutions, but only in those cases where they act as market participants in private legal relations.
The law requires that notification be submitted prior to the activity which alters the state of the market.
If the Competition Council determines that there is a violation of the agreement prohibition in the activities of market participants, it shall take a decision regarding the determination of a violation, legal obligations and imposition of a fine.
