Federal Bureau of Investigation - Wikipedia, the free encyclopedia
The bureau is also charged with the responsibility of enforcing compliance of the United States Civil Rights Act of 1964 and investigating violations of The Act in addition to prosecuting such violations with the United States Department of Justice (DOJ).
At present, the FBI has investigative jurisdiction over violations of more than 200 categories of federal crimes and thus has the broadest investigative authority of any federal law enforcement agency.
Information obtained through an FBI investigation is presented to the appropriate U.S. Attorney or DOJ official, who decides if prosecution or other action is warranted.

The Justice Department is investigating whether FBI agents involved in espionage and terrorism cases may have moonlighted by forming private companies and using informants and subjects of inquiries to benefit their personal business.
FBI agents generally are prohibited from moonlighting in second jobs without special permission, and they are subjected to regular background checks for irregularities.

America Betrayed - Bush Administration, FBI Complicity In 911
However, in order to confirm their suspicions and prevent what they were convinced was a major threat to the United States, the field agents required a criminal search warrant which would allow them to search his personal affect and in particular, his computer lap top.
As detailed by Rowley in a 13 page memo sent to FBI Director Mueller, FBI officials in fact altered and deleted critical information from Rowley's request and purposefully sabotaged it so that a warrant would not and could not be issued.
The alteration and deletion of information contained in the Minnesota warrant request was also a direct violation of FBI regulations.

Administration lawyers asked a judge to prevent a former FBI translator from testifying in a lawsuit brought by families of September 11 victims; the translator told the 9/11 commission that the government had considerable evidence months before the attacks that Al Qaeda was planning to use aircraft as weapons in the United States.
The identity of the plaintiff, the records sought, and most other details regarding the case were unavailable because of the USA Patriot Act.
Los Alamos scientist Wen Ho Lee, who will be tried for mishandling nuclear secrets, made bail after FBI agents admitted making inaccurate statements in previous bail hearings.

Terrorism: Q & A FBI and Law Enforcement
Others say the bureaucratic and cultural issues that plague the FBI and its relationships with other federal agencies—as well as local law enforcement—are too large to be addressed by quick reforms.
As bank robberies, kidnappings, and other types of crime ballooned in the 1930s, new laws were enacted that allowed the FBI to pursue criminals across state lines.
Since September 11, state and local police—who are often the first law enforcement officers involved in cases of suspected terrorism and are required to pass on all terrorism-related information to the FBI—have demanded more intelligence information from the bureau.

CBS News FBI Tries To Limit Info Searches January 21, 2005 10:00:02
Representing the FBI, the Justice Department asked a federal judge this month to dismiss this lawsuit and said its request should not be undermined "by an unsuccessful search for a document as long as the search was adequate." FBI officials declined to further address the ongoing litigation.
In court, the FBI is defending a recent automated search that missed some documents that had been released years ago in a separate FOIA case.
(AP) The FBI is fighting in court to limit how hard it has to search for government documents requested by the public under the Freedom of Information Act, one of the main laws for ensuring openness in government.

 Current FBI Counter-Terrorism Authority
For example, the FBI opened a civil rights investigation into the Rodney King case as soon as officials saw the broadcast of the videotape.
While urging respect for the First Amendment, the guidelines state: "When, however, statements advocate criminal activity or indicate an apparent intent to engage in crime, particularly crimes of violence, an investigation under these guidelines may be warranted...

 Troubling Questions in Troubling Times
The first list which the FBI issued stated that Hani Hanjour is "believed to be a pilot," but the second list published on September 27 by the FBI does not identify Hani Hanjour as being "believed to be a pilot".
Furthermore, Kap said that he gave the FBI their credit card receipts, photocopied driver's licenses, a business card left by one of the suspects and most amazingly, a copy of a Koran that one of the men had left at the bar.
On June 8, 1993, the International Herald Tribune ran an article in which it was stated that the telephone number and apartment listed on the rental agreement for the van belonged to Josie Hadas.

Libraries post Patriot Act warnings / Santa Cruz branches tell patrons that FBI may spy on them
Section 215 of the act allows FBI agents to obtain a warrant from a secret federal court for library or bookstore records of anyone connected to an investigation of international terrorism or spying.
Before demanding records from a library or bookstore under the Patriot Act, he said, "one has to convince a judge that the person for whom you're seeking a warrant is a spy or a member of a terrorist organization.
Unlike conventional search warrants, there is no need for agents to show that the target is suspected of a crime or possesses evidence of a crime.

Wired News: FBI Goes After Bonsaikitten.com
The law, which observers at the time said probably violated the First Amendment, only applies to images, videos, and sound recordings that are distributed "for commercial gain" -- and bonsaikitten.com's tongue-in-cheek descriptions of mail-order cats in bottles appears to have given the FBI sufficient justification for an investigation.
During a floor debate, Rep. Elton Gallegly (R-Calif.) claimed that "sick criminals are taking advantage of the loopholes in the local law and the lack of federal law on animal cruelty videos."
Nadine Pellegrini, the assistant U.S. Attorney who signed the subpoena, refused to discuss the investigation.

 FBI software cracks encryption wall
During the Clinton administration, the FBI found itself on the losing side of a lengthy public debate about the federal government’s ability to circumvent encryption tools.
Sobel was concerned that the keylogging software itself could result in overly broad searches, since it would be possible to observe every keystroke entered by a suspect, even if a court order specified a search only for encryption keys.
If Magic Lantern is in fact used to steal encryption keys, it would not be the first time the FBI has employed such a tactic.

America's Secret Police - FBI COINTELPRO in the 1990s
The FBI paid informant Ron Frazier $54,000 cash in exchange for implicating the Earth First!ers, and granted him immunity from prosecution for various crimes.
The key witness in the case, Julius Butler, was an informant for the FBI, LAPD, and the L.A. District Attorney's office; that information was kept secret during Geronimo's trial.
An uncanny ability to lie under oath, commonly referred to as "testa-lying," is a trademark of rogue law enforcement professionals.

As part of their criminal probe, FBI agents restricted access to some debris and seized other pieces for unspecified reasons for months at a time.

Justice Dept. Cover-Up for FBI Exposed
NACDL is the preeminent organization in the United States advancing the mission of the nation's criminal defense lawyers to ensure justice and due process for persons accused of crime or other misconduct.
Just two weeks ago, NACDL drew attention to FBI abuses revealed in a recent Boston judicial proceeding and in response sent a letter to President Clinton calling on him personally to take corrective actions to rein in the agency and re-establish the rule of law.
U.S. District Court Judge Gladys Kessler, in her 13-page opinion, found that there was a compelling public interest mandating the disclosure of this information, especially "at a time when the credibility of the FBI as a law enforcement institution is being called into question more seriously that at any other time in its history."

When a series of Supreme Court rulings in 1956 and 1957 challenged these committees and questioned the constitutionality of Smith Act prosecutions and Subversive Activities Control Board hearings, the FBI's response was COINTELPRO, a program designed to "neutralize" those who could no longer be prosecuted.
