Whether marriage itself is considered a civil rights issue or not, the fight for the recognition of same sex couples is a civil rights issue because of all the priviliges that accompany legally recognized marriage.
Gay Marriage is most definitly a civil rights issue although it is not exactly the same as the civil rights struggle for blacks.
Gay rights advocates use "civil rights" terminology because they know no one wants to be accused of violating civil rights.

ARGUMENTS AGAINST: A constitutional prohibition is unnecessary because Texas law already prohibits same& marriage and prohibits the recognition by the state or its political subdivisions of a same& marriage, a civil union, or a right or claim asserted as a result of a same& marriage or a civil union.
A constitutional prohibition is inappropriate because it limits future state legislators' flexibility to promote the health and safety of families in whatever form those families may take.

Were I part of a gay couple involved in such a case I would argue simply that the sate must recognize my union because it was not identical or even similar to marriage since the amendment states that marriage required one man and one woman.

The case is made particularly interesting to me in light of the Supreme Court's hearing the Solomon amendment case.
