Many in the United States believe that the right to own guns is not actually based on the second amendment and that if there were no second amendment in the U.S. Constitution, one would still possess a right to own a weapon of self-defense, which in today's context, means guns.
Indeed, there is a historical regularity in that totalitarian regimes pass gun control legislation as a first before restricting civil liberties.
Police-issued license and permit laws, unless drafted to require issuance to those not prohibited by law from owning guns, are routinely used to prevent lawful gun ownership among "unpopular" populations.

The Gun Control Act of 1968 regulated imported guns, expanded gun-dealer licensing requirements, and expanded the list of persons not eligible to purchase guns to include persons convicted of any non-business related felony, minors, persons found to be mentally incompetent, and users of illegal drugs.
Gun control advocate groups also advocate a federal law authorizing only one handgun purchase per month and raising the age for gun ownership from 18 to 21.
Guns are additionally regulated by state and local legislation and there is little uniformity among the states.

The Firearms Act required a would-be gun owner to obtain a certificate from the local chief of police, who was charged with determining whether the applicant had a good reason for possessing a weapon and was fit to do so.
The original common law standard was similar to what still prevails in the U.S. Americans are free to carry articles for their protection, and in 33 states law-abiding citizens may carry concealed guns.
As Glanville Williams notes in his Textbook of Criminal Law, that requirement is "now stated in such mitigated terms as to cast doubt on whether it [self-defense] still forms part of the law."

The NRA agreed that the Supreme Court ruling meant that only militia-type uses for guns are protected under the Second Amendment.
Therefore, the only purpose for which owning and carrying a gun is protected under the Second Amendment is as part of "a well regulated militia," acting on behalf of the national government.
The NRA position that restricting access to guns causes more crime (because then only criminals will have guns), is not supported by evidence at a national level.

 Federal Gun Control Legislation - Timeline
New legislation introduced in the Senate looks to close a "loophole" in federal gun laws that allows unlicensed gun sellers at flea markets and swap meets to sell guns without requiring them to do the same background checks that are required of licensed sellers.
They were also required to record the names and addresses of everyone they sold guns to and were prohibited from selling to those people who were convicted of certain crimes or lacked a permit.
