Topic: Involuntary servitude

Legal Definition of 'Involuntary Servitude & Peonage'
It must be shown that a person held to involuntary servitude was so held for a 'term.' It is not necessary, however, that any specific period of time be proved so long as the 'term' of the involuntary service was not wholly insubstantial or insignificant.
Also, whether a person is paid a salary or a wage is not determinative of the question as to whether that person has been held in involuntary servitude.
In considering whether service or labor was performed by someone against his will or involuntarily, it makes no difference that the person may have initially agreed, voluntarily, to render the service or perform the work.

Sec. 32. Slavery prohibited; involuntary servitude.
That no form of slavery shall exist in this state; and there shall not be any involuntary servitude, otherwise than for the punishment of crime, of which the party shall have been duly convicted.

 Thirteenth Amendment
The Thirteenth Amendment to the Constitution prohibits slavery or involuntary servitude within the United States or any place under its jurisdiction.
The government unconstitutionally authorizes slavery or involuntary servitude when it gives some people the ownership or mastery over others, and when it grants some people the right to use other peoples property.
The Congress would be subjecting those taxpayers to involuntary servitude if it did that.

 Involuntary Servitude Cases
The involuntary servitude case summaries that follow are important, for these cases reveal the fictions the court has used to legalize certain servitudes and legal remedies that Congress passed shortly after the Civil War that enforce the 13th and 14thamendments.
Involuntary servitude imposed upon illegal immigrant as a punishment before being deported.
It does not permit slavery or involuntary servitude to be established or maintained through the operation of the criminal law by making it a crime to refuse to submit to the one or to render the service which would constitute the other.

F.R.E.E. Cases: Moss v. Superior Court
Involuntary servitude is prohibited except to punish crime." When considering involuntary servitude issues we have assumed that the protection extended by article I, section 6, is coextensive with that accorded by the Thirteenth Amendment.
To date however, neither the Supreme Court nor any state court that has enforced a child support order has suggested that undertaking gainful employment in order to avoid sanctions for violation of a valid child support order is analogous to the peonage or involuntary servitude prohibited by the Thirteenth Amendment.
The statute was invalidated under both the Thirteenth Amendment and the Antipeonage Act because it compelled involuntary servitude.

Al Adask on Involuntary Servitude - The Lawful Path
So if you want to defeat the involuntary servitude of implied trust relationships and/or constructive trusts, you must first establish that you live, work or act only "within" one of several "United States" of the Union.
If you agree or merely assent to the court's presumption that you are a 14th Amendment "person" acting "in" the singular, national "United States", you will have NO STANDING to protest the involuntary servitude of implied and constructive trusts.
The 13th Amendment prohibits slavery or involuntary servitude "within the United States, or any place subject to their jurisdiction ".

 Q & A
Section 1584 provided that whoever knowingly and willfully holds to involuntary servitude or sells into any condition of involuntary servitude, any other person for any term, or brings within the United States any person so held, shall be fined not more than $5,000 or imprisonment not more than 5 years or both.
Under the Act, physical coercion is not always required in cases of involuntary servitude.
The Supreme Court concluded that the term "involuntary servitude" does not extend beyond the use or threatened use of physical or legal action.

For a New Liberty by Murray N. Rothbard part 4a
There is no moral excuse, in a society claiming to be opposed to slavery and in a country which has outlawed involuntary servitude, for any legal or judicial action prohibiting strikesor jailing union leaders who fail to comply.
For remember, the only exemption to the Thirteenth Amendment's prohibition of involuntary servitude is "except as a punishment for crime whereof the party shall have been duly convicted"; an accused party has not yet been convicted.
The libertarian believes that a criminal loses his rights to the extent that he has aggressed upon the rights of another, and therefore that it is permissible to incarcerate the convicted criminal and subject him to involuntary servitude to that degree.

www.taxpayerslavery.com - DEMOCRATS: THE ANTI FREEDOM SLAVERY PARTY
Involuntary servitude is illegal in the U.S.A. and is specifically forbidden by the 13th amendment to the Constitution of the United States.
Especially since involuntary servitude is specifically forbidden by the 13th amendment to the bill of rights.
The 13th amendment reads as follows - Neither slavery nor involuntary servitude, except as punishment for a crime whereof the party shall have been duly convicted, shall exist within the Unites States, or any place subject to their jurisdiction.

 Civil Rights (1883)
For the amendment is not a mere prohibition of State laws establishing or upholding slavery, but an absolute declaration that slavery or involuntary servitude shall not exist in any part of the United States.
If such discrimination is a badge of slavery, or places the party discriminated against in a condition of involuntary servitude, then the Civil Rights Act may be upheld by the 13th Amendment.
He who depends for his rights -- not upon the laws of the land, but upon a landlord, is in a condition of involuntary servitude.

But Garaufis noted that the "beneficiaries of Section 1584's protection are victims" of the "constitutionally prohibited practice" of involuntary servitude.
"Moreover, the statute is rooted in the 13th Amendment, which confers upon individuals the federal right to be protected from involuntary servitude," he said.
But Garaufis said the lack of case law on whether a right of action exists for violating the 13th Amendment and 1584 was "not surprising" because "instances of involuntary servitude are rarely found in modern American society."

We offer these Minority views, because we believe that the restrictions imposed under the Committee-reported bill are too harsh, and are likely to unfairly and unnecessarily prevent thousands of victims of sex trafficking and involuntary servitude from being able to obtain relief under our immigration laws.
The problem is that the term "voluntary" could sweep in victims who agreed to a particular improper arrangement, but not to the full extent of sex trafficking or involuntary servitude ultimately imposed upon them.
The Committee-reported bill incorporated several significant restrictions on the availability of visas for victims of sex trafficking and involuntary servitude.

Indentured servitude, peonage, specific performance on labor contracts, and similar conditions, all of which had ensnared Americans of many demographic backgrounds, were also done away by the Thirteenth Amendment.
Put another way, the assemblage of a captive audience by educators constitutes an inherent human rights violation, regardless of what regimen is inculcated upon the captives.

Lilliths Realm - Essay: Involuntary servitude
Therefore, the "involuntary servitude" clause ( 1, 8, 9), that is, the creation of deceptive contract, could be construed as a Government contract between the civilian recruitee and the Military Establishment, and such a contract may be covered by The Contract Disputes Act of 1978, for fair financial compensation.
While the Amendment's reference to slavery pertained to forced labor when a person was in bondage, on the other hand, it was the involuntary servitude part of the Amendment that dealt with the prohibition of forced labor contracts based on trickery and deception ( 8, 9).
With the ratification of the Thirteenth Amendment in 1865, both slavery and involuntary servitude were prohibited.

North Coast Journal - June 1995 - FISCAL FITNESS - Involuntary servitude
Of all the people in a court room, the only ones who are there involuntarily are the accused and the jurors.
If we paid jurors enough so that no one would be forced to serve, the high cost of court cases would climb even more.
The one good thing about the O.J. trial is that it's exhibiting the sorry condition of our justice system.

Liberty and Involuntary Servitude Cannot Coexist
A law placing all young adults in a year or more of involuntary servitude - whether civilian or military - would blatantly violate those basic American principles of individual liberty.
The American ideal of individual liberty could not be more opposed to the fascist notion of having government force adults into years of involuntary servitude.

Moss also ruled that orders from the court for obligors to find work to pay support is unconstitutional.

Moss ruled that both are one in the same and involuntary servitude is unconstitutional.

Any form of slavery is involuntary, it is forced labor that is put upon persons viewed to be insignificant for reasons such as their race, their age, or gender.
