Topic: Justice (disambiguation)

Justice - Wikipedia, the free encyclopedia
In jurisprudence, justice is the obligation that the legal system has toward the individual citizen and the society as a whole.
In some cases, justice is not equated with laws.
If a person lives under a certain set law in a country, concepts of "justice" are often simply deferential to the existing law —the issuing of punitive reprimands for violations may be referred to as "serving justice." In principle, this fits the general concept in that the individuals get what is supposedly due to them.

 YourArt.com >> Encyclopedia >> Judge
The justices of the supreme courts usually hold higher offices than the justice of the peace, a judge who holds police court in some jurisdictions and who typically tries small claims and misdemeanors.
In common law countries, judges usually operate according to the adversarial system of justice under the applicable rules of civil procedure, and usually are not trained separately from lawyers.
Many courts with probate jursidiction give court clerks quasi-judicial authority as "registrars" of the court.

Court - The real meaning from Timesharetalk wikipedia
In common law and civil law states, the courts are the central means for dispute resolution, and it is generally understood that all persons have a right to bring their claims before a court.
A court is an official, public forum which a sovereign establishes by lawful authority to adjudicate disputes, and to dispense civil, labour, administrative and criminal justice under the law.
Such factual evidence as is admitted will only be considered for the purposes of deciding whether the case should be remitted to a first instance court for a retrial unless, in criminal proceedings, it is so clear that there has been a miscarriage of justice that the conviction can be quashed.

To this extent, the freedom of the party, its ability to act freely, would be necessary for justice and thus there would be no difference between justice and revolutionary justice.Solidarity, then, would be the other side of justice.
It is only such a shift of focus onto the Third that effectively uproots justice, liberating it from the contingent umbilical link that renders it 'embedded' in a particular situation.
In other words, it is only such a shift onto the Third that grounds justice in the dimension of universality proper.

I cite: Legal Rationale by Justice Dept. on Spying Effort
The analysis released Thursday by the Justice Department, with comments from lawyers throughout the department, expanded on the legal arguments made in two still-classified legal opinions as well as in a slimmer letter that the department sent to Congress last month.
The basic thrust of the legal justification was the same - that the president has inherent authority as commander in chief to order wiretaps without warrants and that the N.S.A. operation does not violate either a 1978 law governing intelligence wiretaps or the Fourth Amendment ban on unreasonable searches.
But the Justice Department did not back away from its position in Thursday's report, saying the type of "signals intelligence" used in the N.S.A. operation clearly falls under the Congressional use-of-force authorization.
