Legal technicality - definition of Legal technicality in Encyclopedia
Some legal technicalities restrict access to courts and legal procedures or limit the discretion of a court in handing down judgment.
In almost every case, well-established technical aspects of legal procedure have come into being and have been reinforced in a long tradition of appellate court decisions because of a perceived need to protect the rights of a class of persons who might otherwise suffer injustice at the hands of the legal system.
Such cases may be dismissed based on lack of evidence as the illegally obtained evidence would not be allowed to be the basis of the prosecution's case.

 EAP Background Reading
Legal interpreting is a substantial academic field in its own right, so only a brief foray into two major issues is possible: access to appropriate interpreting/translation services, including interpreter supply and certification; and the specific nature of legal interpreting and translation.
The legal system construes external reality in a unique way and legal practice is a distinct microculture, so at least some of this lexical technicality is necessary to express legal notions and refer to legal processes.
Legal technicality is also found in languages other than English and in other legal systems; for instance, Pardo (1996:36) describes legal technicality in Spanish, as does Duarte (1993:66—67) for Catalan.

It is analogous to the legal defense of justifiable homicide, whereby the state does not legalize killing in self-defense, but rather allows the use of self-defense as a defense to a charge of homicide.

I-692 does not legalize the medical use of marijuana; rather it provides a possible legal defense (an affirmative defense) for people charged with possession of marijuana under Washington state law.

 Law Against Social Change
The crippling aspect of the legality myth is the assumption that legality and its correlates of justice, obligation, and responsibility reside only in the law.
The opposite of legal technicality, however, is not chaos, but equity.
As might be expected, although equity's use as a discretionary corrective is accepted in theory in most legal systems, in practice judges often dismiss it precisely because equity implies that the law is inadequate.
