The Patent Act of 1790 was administered by a commission composed of the secretary of state, the secretary of war, and the attorney general of the U.S. The basis of the present patent system is the act of July 4, 1836.
Once a patent is granted, it is out of the jurisdiction of the Patent and Trademark Office, and matters of infringement, the scope of the patent, or any other questions that arise out of the grant are within the jurisdiction of the U.S. district courts.
Copies of U.S. patents may be purchased from the Patent and Trademark Office in Washington, D.C.; photostatic copies of foreign patents may also be obtained on payment of the required fees, as nearly complete sets of the patents of many foreign countries are available in the Patent and Trademark Office library.

The term "patent" originates from the term patere which means to lay open (to public inspection) and the term letters patent, which originally denoted royal decrees granting exclusive rights to certain individuals or businesses.
Furthermore, as the grant of letters patent only grants the right to exclude others from practicing the invention and does not affirmatively grant the right to practice the invention, a patent is not considered a monopoly right.

Outside of England, patent law was the subject of legislative protection in the Venetian Statute of 1474.
This was the start of a long tradition by the English Crown of the granting of "letters patent" (meaning 'open letter', as opposed to a letter under seal) which granted "monopolies" to favoured persons (or people who were prepared to pay for them).
With the French Revolution, which followed the American Revolution, there was controversy over the nature of copyright and patent protections in Europe; those who supported unlimited copyrights frequently used the term property to advance that agenda, while others who supported a more limited system sometimes used the term intellectual rights (droits intellectuels).
