Lobbying is the act of attempting to influence legislation, either directly or indirectly, and is explicitly defined under law as follows.
In the past, courts have said that lobbying expenditures of more than 5% of an organization's total expenditures are substantial, but more recently courts have tended to look at the facts and circumstances of the individual case.
There is no specific classification called "lobbying organization" under federal law, and therefore to qualify for tax-exemption organizations must first meet the requirements of one of the existing classifications.

Since Section 6(5) requires the Secretary and Clerk to "retain registrations for a period of at least 6 years after they are terminated and reports for a period of at least 6 years after they are filed," we recommend registrants retain copies of their filings and supporting documentation for the same length of time.

 Federal Lobbying Regulation
There are two federal lobbying regulations of significance: 31 USC, Section 1352 ("the Byrd Amendment") which prohibits the use of federal funds to engage in lobbying activities and 2 USC, Section 1605 which specifies registration by and semiannual reporting of lobbying activities.
Below is a brief discussion of the Byrd Amendment with respect to what activities are considered lobbying and therefore prohibited when utilizing federal funds.
