Henderson and McKinney are curently incarcerated in the Wyoming State Penitentiary in Rawlins, Wyoming.
The case is often considered a hate crime because Matthew Shepard was targeted on the basis of his sexual orientation; however, under current federal United States law and Wyoming state law, crimes committed on the basis of sexual orientation are not considered hate crimes.
The Shepard case prompted President Bill Clinton to renew attempts to extend federal hate crime legislation to include gay and lesbian individuals, women and people with disabilities.
