OBLIGATION - LoveToKnow Article on OBLIGATION
A perfect obligation is one which is directly enforceable by legal proceedings; an imperfect or moral obligation (the naturalis obliga~tio of Roman law) is one in which the vinculum juris is in some respects incomplete, so that it cannot be directly enforced, though it is not entirely destitute of legal effect.
Obligatio was used to denote either end of the legal chain that bound the parties, the right of the party who could compel fulfilment of the obligatio, the creditor, or the duty of the party who could be compelled to fulfilment, the debitor.
In English law obligation is used in at least four senses(I) any duty imposed by law; (2) the special duty created by a vinculum juris; (3) not the duty, but the evidence of the dutythat is to say, an instrument under seal, otherwise called a bond; (4) the operative part of a bond.

 Legal Definition of Obligation
A civil obligation is one which has a binding operation in law, vinculum juris, and which gives to the obligee the right of enforcing it in a court of justice; in other words, it is an engagement binding on the obligor.
The obligation is personal in another sense, as when the obligor binds himself to do a thing, and he provides his heirs and executors shall not be bound; as, for example, when he promises to pay a certain sum yearly during his life and the payment is to cease at his death.
And in another sense, an obligation still subsists, although the civil obligation is said to be a bond containing a penalty, with a condition annexed for the payment of money, performance of covenants or the like; it differs from a bill which is generally without a penalty or condition though it may be obligatory.

 Legal Obligation and Authority
This obligation purports to be comprehensive in that it covers all legal obligations and everyone whose compliance the law requires.
Scepticism about obligation does not entail scepticism about legitimacy: one may affirm that law is entitled to coerce while denying that all of law's subjects have a duty to obey it.
Thus, a legal right is an interest that warrants holding others under an obligation to protect it, a legal power is the ability to create or modify obligations, and so forth.

 CATHOLIC ENCYCLOPEDIA: Obligation
Originally both parties were considered to be under the obligation to each other; subsequently the term was restricted to one of the parties, who was said to be under an obligation to do something in favour of another, and consequently that other had a correlative right to enforce the fulfilment of the obligation.
Charity or obedience may impose an obligation to give evidence in a court of justice.
However, it may be done for the sake of the public good, and there may be an obligation to do it, as when one's office compels one to undertake the task, or the defence of the innocent or the public good requires it, or a precept of obedience commands it.

 Restitutionary obligation
Restitution is a theory of obligation, like contract or tort, but generally without a law school class of its own.
Restitution is also one possible remedy for breach of contract, alternative to the more common damage remedy that focuses on an injured party's disappointed expectation rather than on the breaching party's unjust enrichment.
While there is a contract between the couple and the dealer for the purchase of a car for $26,500, there is no contract between the two parties relating to the additional $26,500.

 Pension Obligation Bond Financing
In California, city and county pension obligation bonds are issued under the local agency refunding law (drafted in pertinent part by Orrick) and considered valid without a vote under a judicially created exception to the State Constitution Article XVI, Section 18 debt limitation referred to as “obligations imposed by law”.
Because this exception to the constitutional debt limit was and is much less developed in the case law than the other two judicially created exceptions (for lease financing and revenue bonds) each POB issue in California has been validated pursuant to Code of Civil Procedure § 860 et seq.
Subsequent POBs are usually covered by the original validation action without the need of any new judicial proceeding, but this must be reviewed in each case.

Yes, we are willing to talk about the right of children to leave home; but we are not enthusiastic about asking what obligations are incurred by parents because they unilaterally imposed the relationship of dependency in the first place.
And that fact is the foundation of parental obligation.

 FT April 2002: Just War
It is not American exceptionalism, but simple common sense, to recognize that the United States today carries a greater responsibility for order in international politics than, say, Italy or Great Britain.
The public good is the telos of just war thinking; defending and advancing the public good is what legitimate governments are for; and that is why provision for the common defense is a moral obligation of states, not an option.
In any event, the presumption for justice, and for rightly ordered public authority’s moral obligation to pursue justice, is what sets the horizon for moral analysis in just war thinking.
