Topic: Political crime

 Welcome to Netiran!
The 1928 law of punishment for national security crimes: In this law, it was stipulated that it is a criminal crime to organize, establish and participate in anti-constitutional monarchy parties.
Article 168 affords political prisoners the right to have a jury trial and states that the court proceedings must not be held behind closed doors.
Article 54: Political crimes and misdemeanors that advocate revolution, etc. shall absolutely not be pardoned and be a part of a general amnesty.

She comments that, in France, the President is tried only by the High Court of justice in cases of high treason, it being the duty of regular courts to try him in cases of liability resulting from ordinary law.
These political connotations are a privilege of jurisdiction and of proceedings.
She enters the world of comparative law, reviewing the proceedings to establish political-constitutional liability of the United States’ President, through impeachment, and of the French Republic’s President, where the competent court to try him is the High Court of justice, being made of senators and deputies.

 Dealing with political crime
Political corruption is damaging to public trust because it means that the people who are passing and enforcing laws are the ones who are breaking them.
Crimes against the state are called "oppositional political crimes." There are two main types: nonviolent and violent.
Another crime in this category is war crime, which could include launching a war in violation of international law.

Opponents of hate crime laws argue that punishing an offender more harshly when that person commits a crime because of a bias against a class of persons penalizes his or her thoughts and violates the first amendment.
Proponents of hate crime laws counter that hate crime statutes do not conflict with the tenets of the first amendment because they do not punish an individual for exercising freedom of expression but rather for motivation for engaging in criminal activity, a factor often considered when evaluating the seriousness of an offense.
Hate crime statutes have been most frequently challenged on the grounds that they violate the first amendment of the U.S. Constitution, which restricts governments' power to make laws infringing upon an individual's freedom of speech and expression.

The aim of this movement is not necessarily to punish the criminals as this is understood in the logic of a court.
But when it comes to the trial of people involved with massacres, say by a political regime, they are not only unable to fulfil the function of a court, but it is even doubtful that they can even attend as witnesses in a putative court [6].
We need only recall that even if complaints of a people against the crimes of their own government get an ear in one of these international institutions, the complaint cannot be heard unless the accused government agrees to be tried and presents itself in court.

 WowEssays.com - Hate Crimes
The first hate crime law was passed in California in 1978, and since then hate crimes statues have taken many forms, including statues prescribing criminal penalties for civil rights violations, specific “ethnic intimidation” and “malicious harassment” statues, and provisions for enhanced penalties.
Minority groups may push for hate crime legislation simply as a reaction to the threat but they may also use the issue as a means to expand their political agenda (4).
Before we examine the individual states approach to hate crimes, it is important to look at the action taken by the federal government in response to this rising concern.

Social Anarchism/Political Trials and Prisoners in the United States
In such a condition, in which the political heretic is treated just as intolerantly as the religiously orthodox had treated the religious heretic, individuals have historically tried to advance justice and democracy by violating laws, or by advocating the violation of laws, or even by being perceived as violating laws, and always by questioning orthodoxy.
In the second category of political trials and prisoners, the initiation of criminal proceeding rests with persons who deliberately break the law in acts of civil disobedience.
For my special purpose is to advocate the separation of political crimes from ordinary criminal activity and to urge the creation of political crime as a distinct legal entity.

What Are "High Crimes and Misdemeanors"? Bruce Gottlieb
A third group of scholars believes that "high crimes and misdemeanors" refers to "crimes against the state." A crime is against the state when it attacks the very core of the state's apparatus--treason is against the state, jaywalking is not.
The implication is that any competent lawyer in 1789 understood "high crimes and misdemeanors" to refer to crimes against the state.
Other scholars claim that "high crimes and misdemeanors" has a well-defined meaning--it refers to so-called "political crimes" (an old legal term).

Crimes punishable by death in the Penal Code in force, linked to the security of the State (Book II, title I), are divided into those that refer to external security (Chapter I) and those relating to the internal security of the State (Chapter II).
Chapter III sets forth some crimes punishable by death which are crimes against international peace and law, and this section concludes with Chapter IV which sets forth other acts against the security of the State.
The death penalty may be appealed and the remedy shall be decided by the People’s Supreme Court; that appeal is automatically admitted even when not interposed by the accused (Criminal Procedure Law, articles 60 to 64).

"Hate Crimes" Law Undermines Protection of Individual Rights by Robert W. Tracinski -- Capitalism Magazine
A "hate crimes" law would expand the law's concern from criminal action to "criminal thought." It would institute the premise that the purpose of our legal system is not to defend the rights of the victim, but to punish socially unacceptable ideas.
Instead, we should insist on the one principle that forms the foundation for the protection of all rights, i.e., that the purpose of law is to punish criminals for initiating force against others--not for holding bad ideas.

Special attention will be given to serious infractions on human rights by authoritarian regimes and on the administration of criminal justice of these infractions during the transition to a democratic regime.
The central point of interest in this context are the different scenarios to deal with the difficulties in the past: criminal prosecution before a national or international court, the establishment of commissions of truth and the extending of amnesty.
