The exclusive rights conferred by intellectual property laws can generally be transferred (with or without consideration), licensed (or rented), or mortgaged to third parties.
The granting of this permission is termed licensing, and exclusive rights licenses stipulate the extent of the licensee's ability to perform the acts the rightsholder may control.
Furthermore, in the United States physical property laws are generally part of state law, while copyright law is in the main measure federal.

Property rights groups cite the more than one million dollars in fees billed to the plaintiff in one major federal wetlands/taking case, and fees of more than $100,000 appear to be not uncommon.
The property rights issue has flared up because of (1) an increase in government restrictions on private land use in recent decades, (2) increased Supreme Court protection of private property, and (3) the political appeal of the property rights issue as an indirect means for easing regulatory controls.
The property rights issue should not be confused with the takings issue, which deals solely with how the courts interpret the Takings Clause of the Fifth Amendment.

In intellectual property law, there are important distinctions between “exclusive licenses” and “nonexclusive licenses.” An exclusive license is “exclusive” as to a defined scope; it is not the one and only license granted by a licensor.

The definition, allocation, and protection of property rights is one of the most complex and difficult set of issues that any society has to resolve, but it is one that must be resolved in some fashion.
Thus, for example, the owner of an apartment with complete property rights to the apartment has the right to determine whether to rent it out and, if so, which tenant to rent to; to live in it himself; or to use it in any other peaceful way.
Finally, a private property right includes the right to delegate, rent, or sell any portion of the rights by exchange or gift at whatever price the owner determines (provided someone is willing to pay that price).

In order for the court to grant the property rights to squatters, they must prove that they have been on the land "uninterrupted," "non-challenged" and "peacefully" for ten years.
The difficulty of maintaining one's rights over those of the squatters is due to the nebulous nature of the law and what legally passes as "non-cultivated" or "unimproved" land.
Such a distinction is of utmost concem when purchasing property, for the letter of the law must be followed precisely when registering property in order to obtain the full legal title (Carballo, 1993).
