 WIPO Domain Name Decision: D2001-0537
On July 4, 2001, the Center received an e-mail from the Respondent’s Attorneys requesting a right of further reply, in particular, advising the Center that the Respondent had requested a copy of his baptismal certificate.
The certified copy of the Respondent’s baptismal certificate and his Canadian Citizenship certificate show that his full name is as pleaded.
There is no evidence to show that the Respondent registered his domain name with the intent to offer, sell, transfer or lease it to the Complainant.

ICANN Rules for Uniform Domain Name Dispute Resolution Policy
Respondent means the holder of a domain-name registration against which a complaint is initiated.
The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Provider.
(c) If Complainant has elected to have the dispute decided by a single-member Panel and Respondent elects a three-member Panel, Respondent shall be required to pay one-half of the applicable fee for a three-member Panel as set forth in the Provider's Supplemental Rules.

America Online, Inc. v John Deep d/b/a Buddy USA Inc. - Case No. 96795
Given this, the Complainant contends that the Respondent is using the Complainant's famous "ICQ" and "AIM" marks to promote Respondent’s own online services even though the Complainant has neither licensed nor authorized the Respondent to use any of those marks.
The Respondent contends that the absence of a single instance of actual confusion in a nine-month period between the date of registration of Respondent’s domain name and the filing of the Complaint confirms its view that the Respondent, in fact, does not divert traffic from the Complainant’s site or ever intended to divert such traffic.
Furthermore, the Respondent states that although its Aimster software can be downloaded free of charge, this is not evidence of bad faith.

 Gibbons v. Ogden
Now, this right was expressly conferred by the laws of the United States.
Oakley, for the respondent, stated, that there were some general principles applicable to this subject, which might be assumed, or which had been settled by the decisions of this Court, and which had acquired the force of maxims of political law.
There can be no doubt that here is a collision, in fact; that which the appellant claimed as a right, the respondent resisted; and there remains nothing now but to determine, whether the appellant had, as he contends, a right to navigate these waters; because, if he had such right, it must prevail.

David Hume - Essays [Internet Encyclopedia of Philosophy]
In a letter to Henry Home around this time, Hume notes the success of his Essays :
The first volume of Hume's Essays, Moral and Political appeared in 1741, and Hume notes in his autobiography that "the work was favourably received, and soon made me entirely forget my former disappointment"(i.e., the failure of the Treatise).
In one of these papers the editor posed several questions that Hume's essay did not address.

Copyright and Globalization in the Age of Computer Networks - GNU Project - Free Software Foundation (FSF)
DAVID THORBURN, moderator : Our speaker today, Richard Stallman, is a legendary figure in the computing world, and my experience in trying to find a respondent to share the podium with him was instructive.
One distinguished MIT professor told me that Stallman needs to be understood as a charismatic figure in a biblical parable - a kind of Old Testament anecdote-lesson.
The following is an edited transcript from a speech given at MIT in the Communications Form on Thursday, April 19, 2001 from 5:00pm - 7:00pm
