 CATHOLIC ENCYCLOPEDIA: Natural Law
For example, in the eyes of the natural law mutual verbal agreement to a contract is sufficient; yet, in many kinds of contract, the civil law declares that no agreement shall be valid, unless it be expressed in writing and signed by the parties before witnesses.
The United States system of equity courts, as distinguished from those engaged in the administration of the common law, are founded on the principle that, when the law of the legislator is not in harmony with the dictates of the natural law, equity ( æquitas, epikeia) demands that it be set aside or corrected.
Because human actions, which are the subject of laws, are individual and innumerable, it is not possible to establish any law that may not sometimes work out unjustly.

 Kevin's English law glossary: theft
The 1978 Theft Act creates an entirely new offences of `making off without payment', and Ddin would very likely be open to conviction of this offence, but not of theft.
To understand the approach taken to theft in English law, we must examine the primary statutory provisions, and the ways that these have been interpreted in court decisions.
It should be remembered that theft is a serious offence in English law, which is reflected in its maximum penalty of 7 years' imprisonment.

 Naturenet: English Common Law
There are several such legal matters which are very relevant to those in the Countryside, particularly Rangers and those who are required to enforce laws and byelaws.
Apart from a very few examples of local custom and tradition which survive in England's legal system, law which is not contained within a specific Act is known as Common Law.

Consumer Action - CA News - Identity Theft (Spring 2000) [English]
It makes identity theft a federal felony when someone knowingly uses the identification of another person with the intention to commit any unlawful activity under federal and state law.
The new law is welcome, but in order to make a dent in identity theft, the practices of the credit industry must change dramatically.
A number of federal laws and regulations require federal programs and federally funded activities to use Social Security numbers to enforce compliance with laws and determine eligibility for benefits.

Making Sense of English Law Enforcement in the 18th Century
Under English law, any Englishman could prosecute any crime.
The damage payment in civil law provides the victim with an incentive to sue.
The reason the sign is indeterminate is that we do not know whether those who are incapacitated are more or less likely to commit theft than those who will replace them in the positions that provide criminal opportunities.

The state legislators were completely ignorant and thoughtless about the effect the 16th Amendment would have on constitutional law and freedom in the United States.
The result: No state followed the procedures required by law for a constitutional amendment.
It tied up $4 billion of silver bullion in the lawful Treasury of the United States, where it had to be kept in reserve, to cover the redemption of those bills.

After a series of U.S. Supreme Court decisions held that the sovereign immunity clause exempts state entities from adherence to federal intellectual property laws, the Texas Northern District Court took up the question of state immunity from copyright infringement litigation in January 1998.
According to the Eleventh Amendment to the U.S. Constitution, state entities, including universities and libraries, may not be held liable in federal court cases.
Because American copyright law applied only to American publications, European authors were unable to profit from the publication and sale of their works at extemely low prices during the nineteenth century.

This common law was the law made in the king’s courts, especially under Henry II (1154-1189), when judges were sent out around the country and imposed a single central system of law instead of the local systems and customs.
Custom may play a role in English law, as it does in German law, but it isn’t called common law.

Treasure Trove Law In England and Wales
This law survives today in its purest form in Scotland, where all ownerless objects are still Crown property under the principle of bona vacantia.
Since it is Common Law rather than Statute Law no definitive written version exists of Treasure Trove.
The lesson of this case, therefore seems to be that it will always be very difficult to obtain a conviction for theft of Treasure Trove under the current law.

Identity theft is the act of "stealing" or using another person’s personal and/or financial information for personal gain.
Imagine discovering that you, a victim of identity theft, have not only had your money and credit rating stolen, but you also have a criminal arrest warrant issued against you for crimes you never committed in locations you have never visited.
These victims have the added problem of convincing the criminal authorities that the arrest warrant was issued against the wrong person.

The case of Sudds and Thompson, two soldiers who had committed a theft so that they might be sentenced to transportation, was seized on by Wentworth and others as a means of harassing the government.
Trial by jury had become law in 1838, and the first real step towards representative government was effected in 1842 when a new constitution act was passed.
Willis was an able man vain about his knowledge of the law, and a stickler for its dignities.

In a splintered and complex decision that may throw federal criminal cases into short-term chaos, the Supreme Court on Wednesday took the bite out of the federal sentencing guidelines and may have handed back to federal judges the discretion in sentencing they lost 20 years ago after the guidelines were enacted.
Federal appeals courts have split over the degree to which a securities law "safe harbor" provision involving company disclosures provides a shield from shareholder suits.
Commentators said Wednesday that the decision "literally revolutionized federal sentencing law" and gave judges "the greatest sentencing power they've ever had in the history of the republic."
