The French had outlined processes for implimentation of the legal battle even after the duel was widely frowned upon by both church and "state." Judicial dueling was abolished by the saintly king Louis in the 1260's, but the good king was so busy crusading that no one paid much attention to his edicts against dueling..

This was the preferred method of trial for those with privilege, whereas commoners were subjected to trial by fire/water/boiling water or some equivalent, (see Trial by Fire.)
This is often erroneous presented as a battle to the death, but has rarely been such.
Other cases occurred when one combatant could no longer fight due to injury, fatigue, or unconsciousness, or in the case of unarmour combat, when blood is drawn from the torso (as in rapier or pistol duel, which is maintained to the this day in fencing, touché.)
