The U.S. Electoral College vote on December 13, 2004 gave President Bush a 286-251 victory over challenger John Kerry and was certified by the U.S. Congress on January 6, 2005, despite a challenge to Ohio's electoral votes alleging irregularities in that state's election process.
Over 38,000 alleged incidents were reported in the 2004 election, ranging from minor errors to direct voter intimidation, mishandled absentee and provisional ballots, malfunctioning or inaccurate machines and/or apparent hacking and vote tampering.

According to the CPD's website, the criteria for selecting candidates to participate in its 2004 presidential debates are based on evidence of eligibility (as defined in Article Two of the United States Constitution), evidence of ballot access, and evidence of electoral support based on national public opinion polls.
Shortly before the final presidential debate, an individual claiming to be a student at Arizona State University posted on the forums of the liberal website Democratic Underground that he was attempting to use radio equipment to determine whether or not the bulge was caused by a radio transmitter.
(Only Bush, Kerry, and Badnarik have obtained ballot access in the state of Arizona.) A legal hearing in this suit on October 12 did not result in any action regarding the staging of the debate, however, the Arizona Libertarian Party may still seek damages in the case.

Voting machines have been marketed as “assisting voters” (i.e., President [sic] Bush's Elections Assistance Committee), rather than what they really do, which is to interfere with a citizen's right to vote.

With the election looming, states that plan to use the touchscreen systems are rushing to do their own tests or are buying uncertified machines.
The three companies charged with certifying the voting machines have refused to disclose their test results, stating that they are bound to secrecy by the terms of their contracts with the voting machine manufacturers.
