 About Crime Victim Compensation in Michigan
Victim compensation is awarded as a last resort, publicly or privately sponsored insurances and court ordered restitution must be paid first.
Money for crime victim compensation benefits is received from convicted criminal defendants who pay crime victim assessments ordered by Michigan courts.
It is not required that there be an arrest or prosecution of the person responsible for committing the crime, however, the victim is expected to reasonably assist with the investigation and any subsequent criminal case proceedings.

Victims are required to apply for Victim Compensation in the district where the crime occurred by completing an application and submitting itemized bills directly related to the crime in the district where the crime occurred.
Victims may be eligible to receive up to $20,000 for out-of-pocket expenses not covered by insurance or other collateral resources, or up to $1,000 in emergency funds directly related to the crime.
Colorado has a dentralized system, which means that crime victim compensation programs exist in each of the state's 22 judicial districts.

 Texas Attorney General
If the victim or claimant does not agree with the outcome of the final ruling, an appeal may be made to district court.
The Crime Victims' Compensation Fund is the "payer of last resort." It is a secondary source that pays for certain out-of-pocket expenses the victim would be responsible for as a result of the crime.
If the Crime Victims' Compensation Program makes a decision with which the victim or claimant disagrees, the victim or the claimant has a right under the law to ask that the decision be reconsidered.

Victims are originally registered in the program in certain cases as required by the State of Colorado.

 Victim Support Northern Ireland
Victim Support does not make public statements on the punishment and sentencing of offenders, except when discussing issues which directly involve the victim, for example compensation or protection.
Victim Support works in close co-operation with the police, the Northern Ireland Office, the probation service and others within the fields of criminal justice and social welfare in order to improve policies and practices regarding victims and witnesses of crime.

Victims of child abuse comprised 20% of the recipients of crime victim compensation.
But this would mean there would be nothing in the Crime Victims Fund at the beginning of FY '07 -- and that VOCA grants for compensation and assistance would likely not be available in that year unless something extraordinary was done both fiscally and administratively.
A compensation grant at 60% of state-dollar payout means each state must spend $100 to get $60 in a federal grant, which it also must spend -- meaning, of every $160 spent each year, $100 is state, $60 is federal.

 TEXAS CRIME VICTIM RIGHTS - Victim Services Division
(b) A victim, guardian of a victim, or close relative of a deceased victim is entitled to the right to be present at all public court proceedings related to the offense, subject to the approval of the judge in the case.
The failure or inability of any person to provide a right or service enumerated in this article may not be used by a defendant in a criminal case as a ground for appeal, a ground to set aside the conviction or sentence, or a ground in a habeas corpus petition.
A victim, guardian of a victim, or close relative of a deceased victim does not have standing to participate as a party in a criminal proceeding or to contest the disposition of any charge.

 State Unborn Victim Laws
2005 Senate Bill 146, signed into law on May 20, 2005, provided that "a pregnant woman and the embryo or fetus she is carrying in the womb constitute separate and distinct victims" for purposes of the state laws governing murder, manslaughter, and certain other crimes of violence.
Oklahoma: House Bill 1686, signed into law on May 20, 2005, recognizes "an unborn child" as a victim under state laws against murder, manslaughter, and certain other acts of violence.
The "unborn child in the womb at any stage of its development" is fully covered by the state's murder and manslaughter statutes.

 LADA Victim-Witness Assistance Program
Staff orient victims in the court process, accompany them to court, update them on the progress of the court case, arrange transportation to court, and provide a safe waiting area in the courthouse.
However, losses not covered by the program may be recoverable, either through court-ordered restitution as a part of a convicted perpetrator's criminal sentence or through the enforcement of a judgment obtained in a civil lawsuit against the alleged perpetrator.
It is contracted with the Board to process victim compensation claims each year.

Frank G. Carrington, considered by many to be "the father of the victims' rights movement," founds the Crime Victims' Legal Advocacy Institute, Inc., to promote the rights of crime victims in the civil and criminal justice systems.
Two years after its passage, the Victims of Crime Act is amended by the Children's Justice Act to provide funds specifically for the investigation and prosecution of child abuse.

 Judge: Don't Call Kobe Bryant Accuser "Victim" - June 1, 2004
JUNE 1--The woman who has accused Kobe Bryant of rape can not be referred to at trial as a "victim," according to a ruling by the Colorado judge overseeing the NBA star's criminal case.
In the below decision, District Judge Terry Ruckriegle sided with Bryant's attorneys, who argued that the term implied guilt on the 25-year-old athlete's part and essentially robbed him of the presumption of innocence.
The 19-year-old woman will be referred to by her name during the trial, ordered Ruckriegle, who noted that he will continue to refer to her as the "alleged victim." (3 pages)
