A miscarriage of justice is primarily the conviction and punishment of a person for a crime that they did not commit.
Wrongful conviction or miscarriage of justice can also refer to a conviction reached in an unfair or disputed trial.
Most criminal justice systems have some means to overturn, or " quash ", a wrongful conviction, but this is often difficult to achieve.

The Court reasoned that the due process clause requires only that an accused person receive a "fair trial." Therefore, if an innocent person is convicted after a "fair trial," his innocence is a mere error of fact and not a constitutional issue.
To my knowledge, the first publication in the U. that documented cases of wrongful conviction was a 550-page report in the early 1900s by Nashville attorney, K. McConnico.
Though diverse, these publications share a common theme -- wrongful convictions are not an infrequent aberration of an otherwise good system, but are symptomatic of a never-ending plague infecting the core of the law enforcement system.

 Procedure for Reversing a Wrongful Conviction
During the appeal process, the convicted party often sits in prison for as much as a year before an appeal brief is prepared and filed and then, possibly another two years waiting for a decision from their Supreme Court.

There is no general entitlement to recompense for wrongful conviction, for example compensation will not be awarded in cases where at the trial or on appeal the prosecution is unable to sustain the burden of proof against the accused person.
Applications should include the applicant's full name; date of birth; place and date of conviction or details of charge; the circumstances in which the conviction was reversed or the charge dropped; and the reasons why the applicant feels compensation is due to him/her.
The Home Secretary is prepared under certain specified circumstances to pay compensation to those who have been wrongly convicted or charged.

Although authorities with a vested interest in protecting the justice system are apt to minimize the frequency of wrongful convictions while those released are inclined to overestimate it, either estimate is frightening.
The book gives 13 suggestions for public policy proposals that may reduce the frequency of wrongful convictions and restore confidence in the justice system; these range from reduction in reliance upon imprisonment to removing the death penalty.
They are reasonable and may have an effect, but it remains the case that any justice system is administered by people.

We need stricter controls on the use of eyewitness evidence and laws allowing the wrongly convicted to be compensated.
However, it was an exceptionally weak case (the cars barely touched with almost no physical damage) and the eyewitness evidence supporting their case fell apart upon close examination.

Wyniemko's attorney asked the Macomb County Prosecutor's Office to review Wyniemko's pending federal lawsuit, which lays out evidence that suggests witnesses were coached, evidence was buried, conflicting leads were ignored and justice was forsaken for a conviction.
Wyniemko is suing Clinton Township, its police chief and investigating officers, including Ostin, in U.S. District Court in Detroit, claiming his civil rights were violated.
A jury convicted Wyniemko of rape and robbery and he was sentenced to 40 to 60 years in prison.
